Sponsored by Copper Mountain, Inc. (“Copper”), located at 209 Ten Mile Circle, P O Box 3001 Copper Mountain, Colorado 80443.
ELIGIBILITY
This contest is only open to legal residents of the continental United States (excluding RI) and Canada (excluding Quebec) who are between 13 and 18 years of age at the time of the entry. It is subject to all federal, state, and local laws and regulations. Employees of Copper and Woodward Camps, Inc and their respective subsidiaries and affiliates and their agents, advertising, promotion and production agencies and their immediate family members (parents, children, siblings and spouses of children or siblings) and household members are not eligible. Void where prohibited by law.
ENTRY
To enter, visit, http://uservideos.coppercolorado.com/ and submit a video made by the entrant showing skiing or riding. The entry is subject to the video upload policy of Copper which is also found at http://uservideos.coppercolorado.com/. Copper is not responsible for any lost, late, delayed, illegible, incomplete, corrupted, altered, or misdirected entries. Copper is not responsible for incorrect or inaccurate entry information, caused by any technical or human error which may occur in the processing of the entries in this contest. Copper shall not be responsible to any damage to entrant’s computer or software resulting from or suffered in connection with submission of an entry, up-loading a video or otherwise working with the Copper website. By submitting a video the entrant releases Copper and its subsidiaries, retailers, distributors, affiliates and their agents, advertising, promotion and production agencies from all losses and any and all liability for any loss, harm, damages, costs or expenses, damages, rights, claims, and actions of any kind in connection with the Contest, including without limitation, property damages, personal injury and/or death, arising out of participating in this contest, shooting or appearing in or preparation for shooting or appearing in a video and the public display of a video submission.
ALL SUBMISSIONS
All submissions become the property of Copper. Copper reserves the right to, in its sole discretion, cancel, modify or suspend this contest. Potentially offensive entries or entries containing Prohibited Content will not be considered and will be removed from the site displaying video entries based on Copper’s sole judgment and at Copper’s sole discretion. Prohibited Content includes, but is not limited to Content that, in the sole discretion of Copper.
. * Is patently offensive and/or promotes racism, bigotry, discrimination, hatred or physical harm of any kind against any group or individual.
* Harasses or advocates harassment of another person.
* Exploits people in a sexual or violent manner.
* Contains violence, or offensive subject matter.
* Contains information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, vulgar, obscene, defamatory or libelous.
* Contains any telephone numbers, street addresses, last names, URLs or email addresses
Responses must be your own original video, not anyone else’s and the use of other’s copyrighted and/or trademarked material is strictly prohibited. By submitting an entry, you assign all of your rights in your entry, including copyright, to Copper. You hereby give Copper the absolute right to use your entry for any lawful purpose whatsoever in any and all forms of media, in relation to this contest. You hereby waive any right that you may have to inspect or approve the finished product(s), if any, that use your entry and any compensation resulting from the entry you submit.
All entries are subject to verification. Any entry that is tampered with, counterfeited, illegible, mutilated, reproduced, contains errors, obtained where prohibited or not obtained legitimately, is null and void.
SUBMISSION REVIEW
All entries must be received by 11:59 PM Mountain Daylight Time on November 1, 2008 to be reviewed. All entries will be judged based on originality, creativity and passion for skiing or riding or learning to ski or ride, by users of the site on which entries are posted with user ratings being tallied by Copper.
The one (1) entry with the highest overall score will be declared the winner. In the event of a tie, the winner will be decided based on the passion for riding or learning to ride criteria as determined by Copper in its sole discretion.
Review of entries will begin on or about March 17, 2008. All decisions relating to this contest are final.
Winner will be notified by email on or about November 15, 2008. If a Prize Notification e-mail or a prize is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner in a random drawing from among all remaining eligible entries. Limit one (1) prize per person or e-mail address.
PRIZES AND THEIR APPROXIMATE RETAIL VALUE ("ARV")
There is one (1) Grand Prize that will be awarded to one (1) Winner consisting of the a waiver of Woodward at Copper Camp registration and entry fees for a participant between the ages of __ and __. Approximate Retail Value of entry fee is does not exceed Nine Hundred Seventy-Five Dollars (USD $975.00). Odds of winning will be based upon the number of contest entries received by Copper. Winner must make reservation for use of the entry. The party attending the camp must meet qualifications for entry. Prize does not include transportation to Copper Mountain, Colorado and does not include lodging, clothing, helmets, equipment, meals or other goods or services that may be required to take advantage of participation in the Camp. Winner will be responsible for supplying all such items at winner’s own expense.
Limit one (1) Contest entry per individual, family or household. Winner will be solely responsible for all federal, state and local taxes, license fees or other costs. Copper is not responsible for delays in delivery of any prize, and delivery is subject to availability. No substitute prize shall be awarded unless agreed to by Copper. In the event a winner is or becomes ineligible, the prize will be awarded to an alternate winner in a random drawing from among all remaining eligible entries. Copper will not have any obligation to winner if a prize cannot be utilized due to travel cancellation, delays or interruptions, acts of God, natural disasters, terrorism or weather.
Winner of the Contest will be issued W-9 tax forms for the approximate retail value of the prize.
Prizes are non-transferable; no substitutions, exchanges, or cash redemptions. Winner will be required to execute and return an Affidavit of Eligibility and Liability Release within fourteen (14) days of notification or prize will be forfeited and an alternate winner selected. Winner will be solely responsible for any federal, state and local taxes on prize.
By participating in this contest, entrants agree to abide by and be bound by these Official Rules and by the Copper Video Upload Policy. Participants agree that this contest is governed by the laws of the State of Colorado. Any claims arising out of the contest shall be governed by Colorado law and may be brought only in a federal or state court in Colorado. If any provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
By accepting a prize, winner grants to Copper the right to use his/her name, likeness, hometown and biographical information, for any lawful purpose, without further permission or compensation, except where prohibited by law.
By accepting a prize, winner releases Copper and its subsidiaries, retailers, distributors, affiliates and their agents, advertising, promotion and production agencies from all losses and any and all liability for any loss, harm, damages, costs or expenses, damages, rights, claims, and actions of any kind in connection with the Contest, including without limitation, property damages, personal injury and/or death, arising out of the acceptance, possession, use or misuse of any prize.
PRIVACY
By entering the contest, you are agreeing to Copper’s use of your personal information as described in Copper’s Privacy Policies, located at www.coppercolorado.com. You also agree to receive information and offers regarding Woodward Camps in other locations from the sponsor or operator of such camps.
